Public discussion of new draft Law “On enforcement proceedings” with representatives from notary community, banking and credit sectors, NGOs

Today, public discussion of the new draft Law “On enforcement proceedings” took place, which was attended by the representatives of the Ministry of Justice, Compulsory Enforcement Service, notary community, organisations of the banking and credit sectors, as well as NGOs.

Deputy Minister of Justice Levon Balyan delivered a welcome speech. In his speech, the Deputy Minister emphasised importance of the role of such discussions within the framework of judicial and legal reforms and noted that the efforts exerted for three consecutive years for the development of the draft Law are important steps for the judicial and legal reforms and improvement of the legislation in the compulsory enforcement sector.

Chief Compulsory Enforcement Officer Arsen Mnatsakanyan also emphasised in his speech the importance of similar discussions. In his speech, he conditioned the need for adoption of a new Law “On enforcement proceedings”, bringing sector-specific legislation into compliance with European standards to the fact that although the current Law has been repeatedly amended and supplemented, being adapted to one extent or another to the legal developments, however, as a result of fundamental developments of the legal system, a number of issues related to enforcement proceedings have remained unregulated, and some rules can be found in various regulatory legal acts and are not united under a common logic and unified approaches resulting from the effectiveness of enforcement proceedings.

During the discussion, a mention was made to a number of important topics, such as the need for adoption of a new Law “On enforcement proceedings”, bringing sector-specific legislation into compliance with European standards, new solutions and main directions of regulation, new measures of compulsory enforcement, incentive measures of fulfilment of obligation, peculiarities of confiscation of individual types of property and of individual group of enforcement proceedings, etc.

Levon Balyan expressed gratitude to the Council of Europe for organising the meeting and, once again, reaffirmed willingness of the Ministry of Justice for further co-operation, emphasising that similar discussions will contribute to the achievement of the goals pursued by the development of a new legislation.

The discussion was organised by the Council of Europe Project “Support to the effective execution of the judgments of the European Court of Human Rights” funded by the Human Rights Trust Fund and implemented under the Council of Europe Action Plan for Armenia for 2023-2026.
