In regard to the publications released by the presses in relation to the alleged incident between employees of the Compulsory Enforcement Service and citizen A. Yeghiazaryan, we inform that, based on the writ of execution issued by the court, on 15 June of this year, the officers of the Service, once again, performed at X address on Israyelyan Street the actions for expulsion that had been suspended and postponed a few times with various justifications.
During the enforcement actions, conditioned by the health condition of one of the debtors — Susanna M. — the residents of that address called an ambulance. According to the professional medical indication given by a doctor in regard to the health condition of Susanna M., the officers of the Service terminated enforcement actions, in regard to which a relevant record was drawn up. Officers of the Central Division of the Yerevan City Department of the Police also participated in the enforcement actions.
We deem it necessary to inform that the news spread in the media does not correspond to reality and prima facie contains elements of defamation. During enforcement actions no violence has been used by officers of the Compulsory Enforcement Service against debtor A. Yeghiazaryan. In almost the whole period of enforcement actions carried out under the enforcement proceedings, debtor A. Yeghiazaryan behaved improperly, with provocative actions and indecent statements, as well as made an attempt to obstruct performance of the official duties of the compulsory enforcement officers.
Taking into consideration the fact that, according to press releases, investigation is underway and the details of the alleged incident are being cleared up, we urge our partners of mass media outlets to refrain from making publications and commentaries regarding the incident in this stage until all the circumstances are clarified and additional information is provided.
P.S. According to part 1 of Article 47 of the Law of the Republic of Armenia “On the Compulsory Enforcement Service”, compulsory enforcement officers shall have the right to use physical force and special means when preventing resistance shown to them or assault against them in connection with performance of their official duties.
